2. Acceptance of Terms

By accessing this website and/or submitting your personal information through any form on this website, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations.

These Terms constitute a legally binding agreement between you and the Company. If you are submitting information on behalf of another person, you represent that you have the authority to bind that person to these Terms.

  • The quality, licensing, insurance status, or workmanship of any contractor.
  • The accuracy of any quotes or estimates provided by contractors.
  • Whether any contractor is available to perform services at your location.
  • Whether any project will be completed to your satisfaction.

7. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Company's total liability to you for any claims shall not exceed ONE DOLLAR ($1.00).
  • The Company shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages.
  • The Company shall not be liable for damages resulting from a contractor's failure to perform, defective workmanship, property damage, or personal injury.
  • The Company is not liable for any unauthorized use of your personal information by a third-party contractor.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of this website or submission of information.
  • Your violation of these Terms and Conditions.
  • Any dispute between you and a third-party contractor.
  • Any false or inaccurate information you provided.
  • Your violation of any applicable law or third-party rights.

9. Binding Arbitration and Class Action Waiver

9.1 Binding Arbitration. Any dispute arising out of or relating to these Terms or your use of this website shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

9.2 Class Action Waiver. YOU AND THE COMPANY EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes shall be resolved on an individual basis only.

9.3 TCPA Claims. This arbitration agreement expressly covers any claims arising under the Telephone Consumer Protection Act (47 U.S.C. § 227), including claims for statutory damages.

9.4 Exceptions. Either party may seek emergency injunctive relief in court. Small claims court actions that qualify under applicable rules are also excluded.

9.5 Opt-Out. You may opt out of arbitration within 30 days of first submitting your information by sending written notice to legal@theblueneighbor.com.

10. Governing Law and Venue

These Terms shall be governed by the laws of the State of Florida. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of state and federal courts located in Broward County, Florida.

11. Florida-Specific Disclosures

11.2 Florida Do-Not-Call. Your express consent provided upon form submission may supersede Do-Not-Call protections for calls related to the services you requested.

12. CAN-SPAM Compliance

All commercial emails from us will identify themselves as advertising, include our physical mailing address, include an unsubscribe mechanism, and honor unsubscribe requests within 10 business days.

13. Intellectual Property

All content on this website is the property of The Blue Neighbor or its content suppliers and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any content without our prior written consent.
